Advertising of Restricted Breeds for Sale

Residents are reminded that the Companion Animals Act, 1998 prohibits the sale, acquisition and breeding of dogs on the restricted dog list. Restricted dogs are Pitbull Terriers, American Pitbull Terriers, Japanese Tosas, Argentinean fighting dogs (dogo Argentino) and Brazilian fighting dogs (Fila Brasiliero).

The Act also specifies that a person who sells or advertises the sale of a restricted dog or proposed restricted dog is guilty of an offence. The maximum penalty for doing so is 150 penalty units ($16,500). In addition, a person who accepts ownership of such a restricted dog is also guilty of an offence and liable for the same maximum penalty. The term "sell" extends to the transfer of owner by any means, including by gift.

Council's Director Environmental Services, Mr David Casson said that "while the restrictions came into force some time ago, this is a timely reminder to residents of the hefty consequences that can be applied for any person who owns or is contemplating ownership of one of the Restricted Breeds"

Individuals and / or organisations may be subject to penalties if they do not comply with the requirements and Council reminds all members of the community to ensure that they comply with the abovementioned rules and regulations in respect of restricted dog breeds.
